NPDES PHASE II STORM WATER REGULATIONS

On October 29, 1999 the Environmental Protection Agency Administrator, Carol Browner, signed the final Storm Water Phase II Rule. These regulations were published in the Federal Register on December 8, 1999. These regulations are the second phase of a 1987 amendment to the Clean Water Act and are part of the tiered implementation strategy of the National Pollutant Discharge Elimination System (NPDES). The regulations are intended to improve the quality of water.

WHO IS AFFECTED:

These regulations are intended to improve the quality of storm water run off and are primarily directed at the following:

  • Operators of Small Municipal Separate Storm Water Systems (MS4s)
  • Construction activity on sites between 1 and 5 acres
  • Provides revisions to the "No Exposure" rule for industrial facilities

    The greatest impact is likely to be to Small Municipal Separate Storm Water Systems, which are generally speaking any "urbanized area" not being covered under Phase I of the storm water regulations. Automatic designation will likely occur to those urbanized areas with populations between 50,000 and 100,000. The exact designation will need to be determined by the proper regulating agency.
  • WHAT WILL THEY NEED TO DO:

    Each regulating agency will determine the exact requirements for the areas under their jurisdiction. The EPA guidelines for the Phase II regulations state that each affected party will need to submit a permit that outlines a plan that incorporates the following categories:

  • Public Education and Outreach
  • Public Involvement and Participation
  • Illicit Discharge Detection and Elimination
  • Construction Site Runoff Control
  • Post-Construction Storm Water Management
  • Pollution Prevention and Good Housekeeping for Municipal Operations
  • TIME LINE:

    The exact timeline may vary depending on the regulating agency. The EPA time line is listed below:

    December 8, 1999: Final Rule published in the Federal Register.

    October 2000: EPA is obligated to issue menu of recommended Best Management Practices (BMPs) for regulated small MS4s.

    October 2001: EPA is obligated to issue guidance on the development of measurable goals for regulated small MS4s.

    December 8, 2002: The NPDES permitting authorities are required to issue general permits for Phase II regulated small MS4s and small construction activity.

    March 10, 2003: Operators of Phase II regulated small MS4s and small construction activities are required to obtain permit coverage. By the end of the first permit term (typically 5 years) operators of regulated small MS4s would have to fully implement their storm water management programs.

    March 2008 – Operators of regulated small MS4s must fully implement their storm water management programs by the end of the first permit term.
